Cardano Foundation warns EU that expanding MiCA rules to DeFi risks uncertainty

The Cardano Foundation has formally urged European Union policymakers to refrain from expanding the scope of the Markets in Crypto-Assets regulation to cover decentralized finance and staking activities. In its recent policy engagement, the foundation advocated for a regulatory framework grounded in specific financial risks rather than broad underlying technologies. According to the organization, applying traditional financial oversight models directly to decentralized protocols could stifle innovation and create severe compliance hurdles for builders operating within the bloc.

This intervention comes as European regulators continue to evaluate how existing rules apply to the rapidly evolving decentralized sector. Since its initial conceptualization, MiCA has primarily targeted centralized intermediaries, token issuers, and crypto-asset service providers. However, as decentralized applications gain mainstream traction, European authorities have faced increasing pressure to close perceived regulatory gaps, leaving protocols and staking service providers in a state of regulatory ambiguity.

The debate over decentralized finance oversight carries significant implications for the broader European crypto market. If the EU decides to impose rigid structural mandates on permissionless protocols, many developers and liquidity providers might relocate to more accommodating jurisdictions outside the Union. Furthermore, the Cardano Foundation argues that overlapping regulatory requirements would ultimately fail to protect consumers effectively while actively penalizing open-source technological development.

Industry participants and legal experts have largely welcomed the foundation stance, echoing concerns that decentralized code cannot be easily reconciled with centralized compliance structures. Analysts point out that enforcing know-your-customer and licensing requirements on immutable smart contracts is technically unfeasible and fundamentally misunderstands the architecture of decentralized systems. Staking providers similarly warn that overregulation could reduce network security by discouraging community participation in consensus mechanisms.

As the legislative landscape in Europe continues to shift, the dialogue between blockchain organizations and regulators will remain critical. The Cardano Foundation has emphasized its willingness to collaborate with policymakers on targeted measures that address genuine financial crimes without undermining the core benefits of decentralization. All eyes are now on European institutions to see whether they will adapt their approach or press forward with broader regulatory enforcement.
